These terms govern your use of the Carexa website and, unless your organisation has signed a separate agreement with us, the Carexa service. "Carexa", "we" and "us" mean Carexa Health Systems Pvt Ltd. "You" means the person or organisation using the website or service.
If your hospital or clinic has a signed Master Services Agreement with Carexa, that agreement takes precedence over these terms where they differ.
1. Using this website
This website describes software for hospitals and clinics. Nothing on it is medical advice. You may browse this website and share links to it. You may not copy large parts of it, try to break or overload it, or use it to send spam or malicious code.
2. The Carexa service
Access to the service requires an account created under an agreement with your organisation. You are responsible for keeping sign-in details confidential and for activity under your account. Tell us immediately at support@carexaos.com if you suspect unauthorised access.
3. Clinical responsibility
Carexa is a software tool for registered healthcare providers. Alerts, clinical decision support and other suggestions help clinicians but do not replace their professional judgement. Diagnosis and treatment decisions remain the responsibility of the treating clinician and the healthcare facility.
- Alerts can be incomplete. Drug interaction, allergy, dose and other checks depend on reference data and on what has been recorded for the patient. The absence of an alert does not mean a treatment is safe.
- Check before acting. Clinicians should confirm doses, interactions and contraindications against current references and the patient in front of them.
- Records need review. Templates, auto-filled fields and generated documents such as discharge summaries must be reviewed by the responsible clinician before they are signed or shared.
- Not for patients' use. The service and this website do not give medical advice to patients. In an emergency, call 112 or go to the nearest hospital.
- Report safety concerns. If you believe the service contributed to a clinical risk, email support@carexaos.com with "Clinical safety" in the subject.
[Confirm Carexa's status under the Medical Device Rules, 2017 (CDSCO) for its clinical decision support features, and state it here.]
4. Your data
Your organisation owns the data it stores in Carexa. We process it only to provide the service, as described in our Privacy Notice and your data processing agreement. You can export your data in standard formats, including FHIR R4, during the contract and when it ends.
5. Fees
Fees, billing frequency and taxes are set out in your order form. Prices shown on this website are indicative and exclude GST unless stated otherwise. [Confirm free-trial, payment and refund terms.]
6. Acceptable use
- Do not use the service for anything unlawful, or to store data you have no right to process.
- Do not attempt to access other customers' data or probe the service for vulnerabilities without written permission.
- Do not resell or sublicense the service without our agreement.
7. Intellectual property
Carexa, its logo and the software are owned by Carexa Health Systems Pvt Ltd. Using the service does not transfer any ownership rights to you.
8. Warranties and liability
[To be drafted by counsel: service warranties, uptime commitments by reference to the SLA, limitation of liability and indemnities.]
9. Suspension and termination
We may suspend access if these terms are seriously breached or if needed to protect the service or other customers, and will give notice where we reasonably can. On termination we will make your data available for export for [number] days before deleting it.
10. Governing law
These terms are governed by the laws of India. Courts in Bengaluru, Karnataka have exclusive jurisdiction, subject to any dispute-resolution clause in your agreement with us.
